AGATA yra atlikėjų ir fonogramų gamintojų kolektyvinio teisių administravimo organizacija. AGATA Bendrosios investicijų valdymo tvarkos aprašas
Aprašas įgyvendina Lietuvos Respublikos autorių teisių ir gretutinių teisių įstatymo 726 straipsnio ir kitas nuostatas dėl kolektyvinio administravimo pajamų ir turto investavimo. Vadovaujantis Aprašu, pajamų ir turto investavimu turi būti siekiama užtikrinti AGATA atstovaujamų teisių turėtojų interesus. Būtinieji reikalavimai konsultantui
Vadovaujantis Aprašo 12 p., konsultantas privalo turėti Lietuvos banko išduotą finansinio maklerio – konsultanto licenciją.
Pasiūlymų pateikimas ir konkursas
I etapas:
Visus, norinčius dalyvauti konkurse, kviečiame iki 2019 m. spalio 20 d. kreiptis el. paštu agata@agata.lt, nurodant savo kontaktinius duomenis/rekvizitus ir pateikiant informaciją apie turimą Lietuvos banko išduotą finansinio maklerio – konsultanto licenciją.
II etapas:
Su būtinuosius reikalavimus atitinkančiais subjektais iki 2019 m. spalio 25 d. pasirašomi konfidencialumo susitarimai bei nepriklausomumo deklaracijos (dėl interesų konfliktų išvengimo).
III etapas
2019 m. spalio 28 d. visiems konfidencialumo susitarimą bei nepriklausomumo deklaraciją pasirašiusiems konkurso dalyviams bus pateikta vienoda finansinė informacija, kuria remiantis bus prašoma konkurso dalyvių iki 2019 m. lapkričio 15 d. pateikti pasiūlymus konkursui. Dėl konkurso laimėtojo spręs kolegialus AGATA valdymo organas Taryba, atsižvelgiant į šiuos kriterijus:
- pasiūlyme pateiktą informaciją apie numatomą investavimo strategiją (pagrindines gaires);
- numatomą grąžą bei riziką;
- paslaugos kainą;
- reputaciją bei patirtį finansų ir investavimo srityje.
AGATA Taryba taip pat pasilieka teisę nesamdyti nei vieno iš konsultantų, jeigu nebus pateikta AGATA teisių turėtojų interesus atitinkančių pasiūlymų.

AGATA‘s General Investment Policy
The Policy implements Art. 726 and other provisions of Lithuanian Law on Copyright and Neighbouring Rights with regard to the investment of collective rights revenue and other property. According to the Policy, the investment of the rights revenue and other property shall aim at ensuring best interests of the rightholders represented by AGATA. Minimum requirements for the Consultant
In accordance with the Art. 12 of the Policy, the consultant must have a license of financial brokerage – consultant issued by the Bank of Lithuania.
Submission of Proposals and Competition
Stage I
All candidates who are willing to take part in the competition are invited to address AGATA by email agata@agata.lt until the 20th of October, 2019 providing candidate’s contact details / requisites and submitting information with regard to the license of financial brokerage – consultant issued by the Bank of Lithuania and held by the candidate.
Stage II
Until the 25th of October, 2019 the confidentiality agreements and declarations on acting independently (for the avoidance of conflict of interest) will be signed with the candidates meeting the minimum requirements.
Stage III
On the 28th of October, 2019 all candidates who signed the confidentiality agreement and the declaration of independence will be provided with the identical financial information and based on this information all candidates will be asked to submit their proposals for the competition until the 15th of November, 2019. The winner of the competition will be decided by the collegial governing body of AGATA – the Council, based on the following criteria:
1. the information contained in the proposal regarding the envisaged investment strategy (main guidelines);
2. expected return and risk;
3. the price of the service;
4. reputation and experience in finance and investment.
The Council of AGATA also reserves the right not to hire any consultant in the absence of proposals in the interest of the AGATA’s rightholders.
